Viacom 1Q earnings shredded by 'Rock Band'

NEW YORK (AP) ? Viacom Inc., the owner of Paramount Pictures, MTV and Comedy Central, on Thursday posted a 65 percent drop in net income for the latest quarter, as it took a charge related to the "Rock Band" series of video games.

Revenue was below analyst estimates, sending its stock down.

Viacom earned $212 million, or 38 cents per share, in the October-December quarter, down from $610 million, or $1 per share, a year ago.

The New York-based company took a charge of $379 million to cover an arbitration award won by the original shareholders of Harmonix Music Systems Inc., which created "Rock Band."

The game let players take "Guitar Hero" one step further by connecting a drum-kit and a microphone to a game console, along with a guitar, and play and sing along to songs. It was hit when it came out in 2007, but its popularity faded quickly, along with that of "Guitar Hero."

Viacom had acquired Harmonix in 2006, but sold it back to its founders in 2010. The founders then sued, claiming that they were owed extra payments for the performance of "Rock Band" during its spell of popularity. They won an arbitration award of $383 million in December. Viacom is contesting it, but has set aside the money to cover the award, reflected in the charge to earnings.

Excluding the "Rock Band" charge, earnings were $1.06 per share in its fiscal first quarter, a penny above the average analyst estimate as polled by FactSet.

Operating income fell 2 percent as expenses outpaced revenue, which rose 3 percent to $3.95 billion from $3.83 billion. Analysts expected $3.99 billion, mainly because they were expecting advertising to hold up better.

After falling as much as 4.4 percent in morning trading, Viacom's Class B shares had mostly recovered by the afternoon, trading down 21cents at $46.76.

Paramount posted a small operating loss, reversing a small profit a year ago, mainly because it booked a one-time gain then from the sale of some movie distribution rights to Marvel Studios, part of The Walt Disney Co. Revenue rose slightly on strong box-office results from "Paranormal Activity 3" and "Mission Impossible ? Ghost Protocol."

At the TV networks, Viacom's larger and more profitable division, results were buoyed by an increase in fees from cable companies and online streaming services like Netflix. Advertising, the largest single source of revenue, declined 3 percent.

CEO Phillippe Dauman said ad sales would have grown except for a ratings dip at Nickelodeon, as measured by Nielsen Co. The apparent loss of viewers showed up in mid-September. Viacom said in November that it thought the dip was due to some sort of measurement error, and Dauman stuck to that explanation on Thursday.

For its part, Nielsen is sticking to its data, saying in a statement Thursday that it had found no problems with its methodology.

One explanation that has been floated by analysts is that the availability of older Nickelodeon shows on Netflix is digging into viewership. Dauman said he didn't think that was the case. The company gets viewer data from Netflix and didn't see a sudden spike in September, he told analysts on conference call after the release of the results.

The negative data from EU makes ex-Russian Finance Minister Alexey Kudrin believe European currency is doomed to a lengthy decline. He also thinks Greece will leave Eurozone.

In the last weeks of January the situation with the Euro has especially worsened, because creditors fail to agree on writing off a part of the Greek national debt.

Los Angeles teacher charged with molesting 23 kids (AP)

LOS ANGELES ? A Los Angeles elementary school teacher was charged with committing lewd acts against nearly two dozen students after a film processor gave authorities bondage-style photographs showing children in blindfolds with their mouths taped, and some with giant cockroaches on their faces, authorities said Tuesday.

Mark Berndt, 61, was arrested Monday at his Torrance home and remained jailed on $2.3 million bail, according to a Los Angeles County Sheriff's Department statement.

The charges involve 23 boys and girls ages 6 to 10 between 2008 and 2010.

The investigation started when the film processor gave authorities some 40 photographs depicting blindfolded children in a classroom with their mouths taped shut.

Berndt worked for more than 30 years at Miramonte Elementary School in an unincorporated area of South Los Angeles before being fired as a result of the investigation. Miramonte serves a poor, mainly Hispanic neighborhood. More than half of its approximately 1,400 students are still learning English, according to the school's website.

Some of the photos showed Berndt with his arm around children or with his hand over their mouth.

Other pictures depicted girls with what appears to be a spoon up to their mouths as if they were going to ingest a clear-white liquid.

Sheriff's Lt. Carlos Marquez of the Special Victims Bureau said it was determined the children were given semen on a spoon or on a cookie. A blue plastic spoon and container found in trash in Berndt's classroom tested positive for semen, the sheriff's statement said.

None of the photos showed the students actually eating the semen, but Marquez said the children reported they didn't like the taste.

Authorities are recommending the children be tested for sexually transmitted diseases.

Some of the children's mouths and faces had large, live Madagascar-type cockroaches on them, according to the statement.

The incidents occurred during school hours but not all the children were students of Berndt, Marquez said.

None of the alleged victims told anyone about the incidents and photos, Marquez said.

"They didn't know they were being violated in that manner. They just thought it was a game," Marquez said.

The lieutenant said Berndt was placed under surveillance and it's believed he had no contact with children during the investigation.

Berndt is unmarried, has no children and there's no indication of a previous arrest record, authorities said.

"I am sickened and horrified by the behavior of Mark Berndt," Los Angeles Unified School District Superintendent John Deasy said in a statement.

The teacher was immediately removed when the Sheriff's Department informed the district, and he was fired, Deasy said.

More than 80 current and former students and school employees were interviewed for the investigation.

Searches of the classroom and Berndt's home turned up about 390 photographs depicting children, and at least 10 youngsters in them have not yet been identified, Marquez said.

In addition, A DVD depicting adult sexual bondage activity "which mirrored the bondage-type photos of the children" was also found during the search, the department said, noting that the adults in that video were not identified and those images are not a crime.
